Welcome to Peachy Keen. These Terms & Conditions apply to your use of our website and to purchases made through our online store.
By using our website or placing an order with Peachy Keen, you agree to be bound by these Terms & Conditions. Please read them carefully before making a purchase.
1. About Peachy Keen
Throughout these Terms, “Peachy Keen”, “we”, “us” and “our” means Peachy Keen. “You” and “your” means the customer or person using our website.
We sell stickers, labels, stationery, vinyl decals and related products, including custom and personalised products.
2. Products and Product Information
We make reasonable efforts to ensure product descriptions, photographs, colours, measurements and other information are accurate. Colours may appear differently depending on your device or screen settings.
Some products are handmade, printed or prepared individually, so minor variations may occur.
We may update, change or discontinue products from time to time. Any change will not affect an order that we have already accepted.
3. Custom and Personalised Products
For products made using names, text, dates, colours, designs, measurements or other information supplied by you, you are responsible for checking that information before placing your order.
Please carefully check spelling, names, dates, colours, sizes and other personalised details. Peachy Keen is not responsible for an error in a personalised product where the error was contained in the information supplied by the customer.
Where clarification is reasonably required, we may contact you before producing a custom order. This may affect the processing time.
4. Customer-Supplied Artwork and Content
If you provide artwork, logos, images, text or other material for use in a product, you confirm that you have the necessary rights or permission to use it.
You must not provide material that infringes another person's copyright, trademark, intellectual property or other legal rights.
You remain responsible for claims arising from material supplied by you.
5. Orders
When you place an order, you are offering to purchase the selected products from us on these Terms.
We may accept or decline an order for a genuine reason, including product availability, suspected fraud, an obvious pricing or listing error, or an inability to fulfil the order.
If we cancel an order after payment has been received, we will arrange a refund of the amount paid for the cancelled order.
6. Pricing and Payment
All prices are displayed in Australian dollars (AUD), unless otherwise stated.
Prices may change from time to time. Price changes will not affect an order already accepted by us.
Payment must be successfully completed using an available payment method at checkout, which may include card payments, Shop Pay, Afterpay or other payment methods offered through our store.
Third-party payment providers may have their own terms and conditions and privacy policies.
7. Shipping
Peachy Keen currently ships within Australia only.
Available shipping methods, delivery estimates and shipping charges are shown at checkout or otherwise communicated with your order.
Please make sure your delivery address is correct before completing your purchase. If an order is returned because an incorrect or incomplete address was provided, additional postage may be required to resend it.
Delivery estimates are guides only unless we expressly state otherwise. Once an order has been dispatched, delivery is also dependent on the relevant postal or courier service.
We will take reasonable steps to assist with delayed, lost or damaged deliveries, but we cannot control third-party delivery networks.
8. Processing and Production Times
Orders may require processing or production time before dispatch. Any timeframe shown on a product listing, at checkout or elsewhere on our website is an estimate unless expressly stated to be guaranteed.
Custom and personalised products may require additional processing time.
If we become aware of a significant delay affecting your order, we will take reasonable steps to communicate with you.
9. Returns, Refunds and Australian Consumer Law
Your rights under the Australian Consumer Law (ACL) apply to purchases from Peachy Keen. Our store policies operate alongside, and do not replace, those legal rights.
Nothing in these Terms & Conditions excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under Australian law.
If a product is faulty, damaged, not as described, or otherwise does not meet an applicable consumer guarantee, please contact us with details of the issue and, where appropriate, photographs. We will assess the issue and provide any remedy required by law.
Where a customer simply changes their mind, a refund or exchange is only available if provided for by our applicable returns policy or otherwise required by law.
Custom or personalised products may have different change-of-mind return conditions where they were correctly made according to the information supplied by the customer. These conditions do not limit any rights you have where the product has a problem covered by the ACL.
10. Vinyl Decals and Application
Vinyl decals should be applied using any instructions supplied with the product and only to surfaces suitable for vinyl application.
The surface should generally be clean, dry and free from dirt, grease, dust and other contaminants before application.
Peachy Keen is not responsible for damage caused by incorrect application, removal, unsuitable surfaces, improper cleaning, environmental conditions or use contrary to supplied instructions, except where responsibility cannot legally be excluded.
Customers should take appropriate care when applying or removing decals from painted surfaces, vehicles, walls, furniture, glass or other surfaces.
11. Intellectual Property
Unless otherwise stated, the content of the Peachy Keen website, including photographs, graphics, logos, branding, product designs, text and other materials, belongs to or is used by Peachy Keen with permission.
You must not copy, reproduce, modify, distribute, sell or commercially exploit our content without our prior written permission.
Buying a product does not transfer ownership of Peachy Keen's intellectual property to you.
12. Website Use
You agree to use our website only for lawful purposes and in a way that does not interfere with its operation or security.
You must not attempt to gain unauthorised access to the website, introduce malicious code, interfere with other users or use the website for fraudulent or unlawful activity.
13. Third-Party Services
Our store relies on third-party services, which may include Shopify, payment providers, delivery providers, analytics services and other service providers.
Your use of third-party services may also be subject to their own terms and privacy policies. We are not responsible for third-party services to the extent that matters are outside our reasonable control.
14. Website Availability and Information
We make reasonable efforts to keep our website available and information accurate and current, but we do not guarantee that the website will always be uninterrupted, error-free or completely up to date.
We may correct errors, update information or make changes to the website at any time.
15. Liability
To the maximum extent permitted by law, we are not responsible for loss caused by circumstances outside our reasonable control.
Nothing in these Terms limits or excludes liability, consumer guarantees, rights or remedies that cannot legally be limited or excluded under Australian law.
16. Events Outside Our Reasonable Control
We are not responsible for delays or failures caused by circumstances reasonably outside our control, including natural disasters, extreme weather, postal or courier disruption, technical failures, power outages, government restrictions, industrial action or other unforeseen events.
Where reasonably possible, we will communicate with affected customers and take reasonable steps to minimise the impact.
17. Changes to These Terms
We may update these Terms & Conditions from time to time. The latest version will be published on this page with the relevant “Last updated” date.
Changes will apply from the date they are published, except where the law requires otherwise. The Terms applicable to an order are those in effect when the order is accepted.
18. Australian Law
These Terms & Conditions are governed by the laws applicable in Australia.
Nothing in these Terms is intended to exclude, restrict or modify your rights under the Australian Consumer Law or any other applicable law.
